The brothers charged in the 2006 death of Gabriola Island resident Michael Brophy are scheduled to be sentenced Friday (April 25) in Nanaimo.
Timothy Maybin entered a guilty plea to manslaughter earlier in the month, while brother Matthew Maybin entered a guilty plea to assault causing bodily harm, according to Crown counsel Carmen Rogers.
Both men were charged with manslaughter following an October 2006 incident at the former Grizzly Bar in the Howard Johnson Hotel, where the brothers were alleged to have fought with Brophy, beating him until he was unconscious.
Buddha Gains, a bouncer at the bar, was charged with assault causing bodily harm, after he allegedly punched Brophy while he was unconscious.
Brophy died from internal bleeding in the brain.
The three were acquitted in 2008 after a judge ruled that it could not be determined who struck the fatal blow or whether the three acted together.
The Crown appealed the acquittals in 2010. The brothers appealed to the Supreme Court of Canada but the judges upheld the provincial court decision and a re-trial was ordered in 2012, according to Rogers. The trial would've started in May.
Rogers said Gains is expected to enter a guilty plea to assault causing bodily harm on the same day as the brothers' sentencing.
