NOTICE TO ELECTORS OF THE CITY OF NANAIMO OF AN ALTERNATIVE APPROVAL PROCESS

“PUBLIC WORKS YARD UPDATES BORROWING BYLAW 2024 NO. 7386”

A bylaw to authorize the borrowing of up to $90,000,000 for the construction of the Public Works Yard Updates

The Council of the City of Nanaimo intends to consider adoption of “PUBLIC WORKS YARD UPDATES BORROWING BYLAW 2024 NO. 7386”.

Notice is Hereby Given, pursuant to the Community Charter, of an alternative approval process in relation to the proposed bylaw and the borrowing authorized by it. This approval process applies to the whole of the City of Nanaimo.

If adopted, the proposed bylaw will authorize Council to borrow up to $90,000,000 to finance the cost of replacing the Public Works Fleet Maintenance and Crew/Administration buildings which will be repaid over a period not to exceed twenty (20) years.

The proposed bylaw, if adopted, will also empower Council to acquire all such real property, easements, rights of way, licenses, rights or authorities as may be requisite or desirable for or in connection with the construction of the project listed above. This includes the planning, study, design and construction of the Public Works Yard Updates, including services generally to buildings, works and operations facilities to serve the City of Nanaimo.

A copy of the proposed bylaw and other information regarding the Public Works Yard Updates is available for viewing on the City website at www.nanaimo.ca. or at the Legislative Services Department at City Hall, 455 Wallace Street, Nanaimo, BC, during regular office hours: Monday – Friday from 8:30 a.m. – 4:30 p.m. excluding statutory holidays.

Council may proceed with the proposed bylaw and the borrowing authorized by it unless by 4:30 p.m. on Thursday, October 31, 2024, at least ten (10) percent of the electors in the City of Nanaimo sign and submit an elector response form opposing the bylaw and the borrowing authorized by it, indicating that Council must obtain the assent of the electors (referendum) before proceeding with the proposed bylaw and the borrowing authorized by it.

The number of elector responses required to prevent the Council from proceeding with the proposed bylaw and the borrowing authorized by it without the assent of electors (referendum) is 7,974. A report respecting the basis on which this determination was made is available upon request.

Elector Response Forms

Every eligible elector is entitled to submit one (1) elector response form in response to an Alternative Approval Process (AAP). The response of the elector must be in the form established by the Council. Elector response forms are available from Legislative Services at City Hall, 455 Wallace Street, Nanaimo, BC, V9R 5J6, Monday through Friday, 8:30 a.m. to 4:30 p.m. excluding statutory holidays. The form can also be downloaded from the City of Nanaimo website at www.nanaimo.ca/goto/aap beginning at 8:30 a.m. on September 18th.

In accordance with Council Policy “COU-242 Alternative Approval Process (AAP) Policy” a maximum of ten (10) printed copies of an elector response form will be provided per individual throughout the AAP process.

Elector Response Form Deadline

Signed elector response forms must be received by the Corporate Officer (or designate) at the Legislative Services Department, City Hall (455 Wallace Street, Nanaimo BC) no later than 4:30 p.m. on October 31, 2024.

In accordance with Council Policy “COU-242 Alternative Approval Process (AAP) Policy” completed forms may be submitted:

1. In person at the Legislative Services Department, City Hall, 455 Wallace Street, Nanaimo, BC (Monday to Friday during regular business hours, excluding Statutory Holidays);

2. Via mail to: Legislative Services Department, 455 Wallace Street, Nanaimo, BC, V9R 5J6; or

3. Through electronic submission on the City of Nanaimo’s website: https://www.nanaimo.ca/goto/AAP-submissions

If submitting an elector response form by mail, please note post marks are not accepted as the date of submission. It is the responsibility of the elector to ensure the response form is received by the deadline. Elector response forms being submitted electronically through the submission webpage must be uploaded as either a scanned copy or a photo of an original hand-written (physically) signed form. Electronic signatures will not be accepted and elector response forms will NOT be accepted via email or fax.

Eligible Electors

The only persons entitled to sign an elector response form are the electors within the municipal boundaries of the City of Nanaimo, which as indicated above is the area to which the approval process applies. There are two types of electors – resident electors and non-resident property electors.

Resident Elector: When signing an elector response form during an AAP, a resident elector must: be 18 years of age or older; be a Canadian citizen; have been a resident in British Columbia for at least six months; live in the area defined for the AAP; and, not be disqualified under the Local Government Act, or any other enactment from voting in a local election, or be otherwise disqualified by law.

Resident electors signing the elector response form must provide their full name and residential address.

Non-resident Property Elector: When signing an elector response form during an AAP, a non-resident property elector must: be at least 18 years of age; be a Canadian citizen; have been a resident in British Columbia for at least six months; have owned real property in the City of Nanaimo for at least 30 days; and, not be disqualified under the Local Government Act, or any other enactment from voting in a local election, or be otherwise disqualified by law.

Note (Non-resident Property Elector): If there is more than one registered owner of the property (either as joint tenants or tenants in common), only one of those individuals may, with the written consent of the majority of the owners, register as a non-resident property elector. A copy of the written consent provided by the majority of owners must accompany the elector response form when submitted by the non-resident property elector. A person may only register as a non-resident property elector in relation to one parcel of real property in a jurisdiction.

Non-resident property electors must provide their name and the address of the property in relation to which they are entitled to register as a non-resident property elector.

The City of Nanaimo will not share the information on the elector response form with anyone other than the Corporate Officer, or other persons designated by the Corporate Officer.
