At the regular Council Meeting on November 20, 2024, at 6:00pm virtual (Zoom Webinar platform) and livestreamed at lantzville.ca District of Lantzville Council will give first reading to the following proposed Bylaw:
“District of Lantzville Zoning Bylaw No. 180, 2020, Amendment (7052 Peterson Road and 7356 Lynn Drive) Bylaw No. 379, 2024”.
SUBJECT PROPERTIES
The Bylaw amendment applies to the following parcels:
• 7356 Lynn Drive: LOT 2, DISTRICT LOT 54, NANOOSE DISTRICT, PLAN 20725
• 7052 Peterson Road: LOT 6, BLOCK 2, DISTRICT LOT 54, NANOOSE DISTRICT, PLAN 1909 EXCEPT THAT PART IN PLAN 13980
PURPOSE
To amend “District of Lantzville Zoning Bylaw No. 180, 2020” by rezoning the following parcels to facilitate a 7-lot residential subdivision:
• 7356 Lynn Drive from Future Special Area Plan (F-SAP) to Residential 4 (R4).
• 7052 Peterson Road from Future Special Area Plan (F-SAP) to Estate Residential (EST).
• The wetland on 7052 Peterson Road from Future Special Area Plan (F-SAP) to Park (P).
PER THE LOCAL GOVERNMENT ACT
Section 464 (3) of the Local Government Act states:
A local government must not hold a public hearing on a proposed zoning bylaw if:
a) an Official Community Plan is in effect for the area that is the subject of the zoning bylaw,
b) the bylaw is consistent with the Official Community Plan,
c) the sole purpose of the bylaw is to permit a development that is, in whole or in part, a residential development, and
d) the residential component of the development accounts for at least half of the gross floor area of all buildings and other structures proposed as part of the development.
Section 467 (1) of the Local Government Act states:
If a local government decides not to hold, or is prohibited from holding, a public hearing referred to in section 464 (2), (3) or (4) [public hearing not required, or prohibited, for certain zoning bylaws] on a proposed zoning bylaw, it must give notice in accordance with this section.
